Regulations Limit Drive Time and Require that Truck Drivers Get Rest

The Federal Department of Transportation (DOT) restricts drivers’ hours of drive time and shift time and requires that truck drivers to take rest breaks while traveling long distances. In addition, truck drivers are supposed to keep a log detailing their hours of operation and rest. These logs are periodically audited to ensure that drivers remain in compliance with the law and are reviewed by investigators after a crash.

As of December 2017, trucking companies are required to install an electronic logging device (ELD) on all vehicles in their fleet. The ELD automatically records when the truck is in operation, thereby rending the easily manipulated handwritten logbooks to history.

Many trucking companies put their drivers under immense economic pressure to get their loads delivered as soon as possible, often under impossible deadlines. In the past, these pressures led some truckers to falsify their logbooks and to continue driving past the HOS-mandated maximum hours. Trucking companies often looked the other way because the end result—an on-time delivery—is all they really care about. In addition to hours of driving, the ELDs record tampering to the devise, and thereby making logbook falsification very difficult.

The ELDs may deter sleep-deprived drivers from getting behind the wheel. For truckers who drive despite their fatigue, ELDs provide a valuable enforcement tool. Violation of HOS rules is negligence per se, meaning the driver is presumed to have acted negligently by driving or working past the permissible legal hours.

A Tired Truck Driver Is a Dangerous Truck Driver

With their enormous size and the heavy loads they carry, semi-trucks are dangerous enough as it is. But put a tired driver behind the wheel, and they become even more of a hazard. Truck drivers who get tired lose their alertness and ability to react quickly to sudden events. In the worst cases, they may even drift in and out of sleep while driving.

Exacerbating the situation, when truck drivers become sleepy, they often take stimulants to stay awake. Whether an over-the-counter stimulant that just contains caffeine or an illegal drug, these substances may keep the driver awake, but do not improve the driver’s attention, alertness, or ability to maintain control of the vehicle. Impairment further increases a tired driver’s risk of accident.
