What Type of Damages Can I Recover If I've Been Injured in a Car Accident?

If you have been hurt in car accident in Texas, you are entitled to recover money damages from the other driver’s car insurance company.  Listed below are the types of damages you can recover under Texas law.

·    PAST LOST WAGES- If the car accident has made you miss work, then you are entitled to recover the amount of lost wages you have missed out on.   You may also recover for the sick leave or vacation time you had to use as a result of the car accident.

·    LOSS OF EARNING CAPACITY-if the car accident requires you to miss work in the future or change professions, then you can recover for all of the future lost wages. To recover, you will need medical documentation that you will not be able to work or cannot continue performing your old job.

·    PAST MEDICAL EXPENSES- You are entitled to recover the costs of "reasonable and necessary" medical expenses that are the result of the car accident.     This element of damages pays for all medical bills, including ambulance, emergency room visits, doctors, specialists, surgeons, physical therapists, chiropractors, etc. In most car accident cases, past medical expenses is the largest portion of recoverable damages.

·    FUTURE MEDICAL EXPENSES- You may also recover for medical bills you will have to incur in the future as a result of the car accident.  To recover theses types of damages, you will need a doctor to estimate the amount of medical expenses you will incur in the future.  The doctor must indicate that there is a "reasonable medical probability" that the medical bills will be incurred.

·     PAIN AND SUFFERING AND MENTAL ANGUISH-  Car accidents can cause a large amount of pain and suffering.  This is shown through the need of treatment as well as the need for pain medication.  You may  recover for the physical pain as well as the mental anguish you have suffered.  Mental Anguish damages can include a wide variety of things such as no longer being able to play games with your children, or the fears that you now have as a result of the car accident.

·    DISFIGUREMENT- If the car accident has left you with scarring or a disfigurement, then you are entitled to recover for those damages. The more noticeable the scar, the more value it has to the insurance company. Scars on women are normally worth more than scars on men.
